Jesus the Jew is the primary signifier of Christianity's indebtedness to Judaism. This connection is both historical and continuous. In this book, Barbara Meyer shows how Christian memory, as largely intertwined with Jewish memory, provides a framework to examine the theological dimensions of historical Jesus research. She explores the topics that are central to the Jewishness of Jesus, such as the Christian relationship to law, and otherness as a Christological category. Through the lenses of the otherness of the (...) Jewish Jesus for contemporary Christians, she also discusses circumcision, natality, vulnerability, and suffering in dialogue with thinkers seldom drawn into Jewish-Christian discourse, notably Hannah Arendt, Julia Kristeva, Martha Nussbaum and Adi Ophir. Meyer demonstrates how the memory of Jesus' Jewishness is a key to reconfiguring contemporary challenges to Christian thought, such as particularity and otherness, law and ethics after the Shoah, human responsibility, and divine vulnerability. This book includes essays on writers from the 1840s to the 1890s, well known writers such as Anne Bronte, Wilkie Collins and Bram Stoker, lesser known writers such as Geraldine Jewsbury, Charles Reade, Margaret Oliphant, George Moore, Sarah Grand and Mary Ward. The contributors explore important thematic concerns: the relation between private and public realms; gender and social class; sexuality and the marketplace; and male and female cultural identity.

As the implementation of new approaches and procedures of medical ethics is as complex and resource-consuming as in other fields, strategies and activities must be carefully planned to use the available means and funds responsibly. Which facilitators and barriers influence the implementation of a medical ethics decision-making model in daily routine? Up to now, there has been little examination of these factors in this field. A medical ethics decision-making model called METAP was introduced on three intensive care units and two (...) geriatric wards. An evaluation study was performed from 7 months after deployment of the project until two and a half years. Quantitative and qualitative methods including a questionnaire, semi-structured face-to-face and group-interviews were used. Sixty-three participants from different professional groups took part in 33 face-to-face and 9 group interviews, and 122 questionnaires could be analysed. The facilitating factors most frequently mentioned were: acceptance and presence of the model, support given by the medical and nursing management, an existing or developing ethics culture, perception of a need for a medical ethics decision-making model, and engaged staff members. Lack of presence and acceptance, insufficient time resources and staff, poor inter-professional collaboration, absence of ethical competence, and not recognizing ethical problems were identified as inhibiting the implementation of the METAP model. However, the results of the questionnaire as well as of explicit inquiry showed that the respondents stated to have had enough time and staff available to use METAP if necessary. Facilitators and barriers of the implementation of a medical ethics decision-making model are quite similar to that of medical guidelines. The planning for implementing an ethics model or guideline can, therefore, benefit from the extensive literature and experience concerning the implementation of medical guidelines. Lack of time and staff can be overcome when people are convinced that the benefits justify the effort. (shrink)

We describe how a Community-Based Participatory Research (CBPR) process was used to develop a means of discussing end-of-life care needs of Deaf seniors. This process identified a variety of communication issues to be addressed in working with this special population. We overview the unique linguistic and cultural characteristics of this community and their implications for working with Deaf individuals to provide information for making informed decisions about end-of-life care, including completion of health care directives. Our research and our work with (...) members of the Deaf community strongly show that communication and presentation of information should be in American Sign Language, the language of Deaf citizens. This article argues that the causal loops that occur in some time-travel scenarios and in certain solutions of the theory of relativity are no more mysterious than the infinitely descending causal chains familiar from Newtonian mechanics.

The purpose of the current study was to examine the reliability and validity of the RESTQ-Sport-36 for use in the collegiate student-athlete population. A total of 494 collegiate student-athletes competing in National Collegiate Athletic Association Division I, II, or III sanctioned sport completed the RESTQ-Sport-36 and Brief Profile of Mood States. Structural equation modeling procedures were used to compare first order to hierarchical model structures. Results of a confirmatory factor analysis and exploratory structural equation modeling analysis indicated that the first (...) order 12-factor structure demonstrated the best fit of all models tested. Support was not observed for the fit of any hierarchical model. Moderate to strong correlations were observed between stress and recovery subscales and mood states, thus supporting the construct validity of the abbreviated RESTQ measurement model. The current findings provide support for the measure’s use in this population and give pause as it relates to the scoring and interpretation of hierarchical factors such as Total Stress and Total Recovery. Overall, the current results indicate that the RESTQ-Sport-36 may be a useful tool for collegiate student-athlete training load and competition monitoring. (shrink)

Therapieentscheidungen lösen in klinischen Teams häufig Unsicherheiten und Konflikte aus, insbesondere wenn es um schwerkranke Patienten geht. Fallen Entscheidungen vornehmlich situationsgeleitet, sind bestimmte Patientengruppen einem Risiko der Unter-, Über- oder Ungleichversorgung ausgesetzt. Der Metap-Leitfaden unterstützt Ärzte, Pfleger und Therapeuten daher in ihrer ethisch reflektierten Entscheidungskompetenz mit verschiedenen Orientierungs- und Entscheidungsinstrumentarien. Diese berücksichtigen eine gerechte Zuteilung der Ressourcen.

Progressive supranuclear palsy is a movement disorder with prominent tau neuropathology. Brain diseases with abnormal tau deposits are called tauopathies, the most common of which is Alzheimer's disease. Environmental causes of tauopathies include repetitive head trauma associated with some sports. To identify common genetic variation contributing to risk for tauopathies, we carried out a genome-wide association study of 1,114 individuals with PSP and 3,247 controls followed by a second stage in which we genotyped 1,051 cases and 3,560 controls for the (...) stage 1 SNPs that yielded P ≤ 10-3. We found significant previously unidentified signals associated with PSP risk at STX6, EIF2AK3 and MOBP. We confirmed two independent variants in MAPT affecting risk for PSP, one of which influences MAPT brain expression. The genes implicated encode proteins for vesicle-membrane fusion at the Golgi-endosomal interface, for the endoplasmic reticulum unfolded protein response and for a myelin structural component. © 2011 Nature America, Inc. Ethische Leitlinien für die klinische Praxis erfreuen sich zunehmender Beliebtheit. Damit klinisch-ethische Leitlinien aber überhaupt erfolgreich wirksam werden können, ist noch Pionierarbeit zu leisten. Solche Leitlinien müssen wissenschaftlich stärker fundiert und ihre praktische Anwendbarkeit muss verbessert werden. In dieser Arbeit werden die ersten Schritte des Projekts METAP zur methodischen Entwicklung und praktischen Implementierung einer Leitlinie für eine patientengerechte Versorgung am Krankenbett beschrieben und zur Diskussion gestellt. Das Projekt orientiert sich methodisch an der Entwicklung medizinischer Leitlinien und generiert damit eine forschungs- (...) und konsensgestützte Leitlinie, die systematischer Evaluation und Modifikation unterliegt und Rechenschaft über ihre wissenschaftliche Fundierung gibt. Zusätzlich zur Leitlinie bietet das Projekt in der Form eines Handbuchs ein Entscheidungsfindungsverfahren an, welches unter anderem deliberative Aspekte unterstützt. Das Handbuch konzentriert sich auf ethische Fragen der Mikroallokation und liefert darüber hinaus Informationen über empirische, ethische und rechtliche Grundlagen für Therapieentscheidungen. Anhand eines Eskalationsmodells können unterschiedliche Instrumente nach Bedarf als ethische Lösungsstrategien eingesetzt werden, von der Kurzfassung im Kitteltaschenformat („Leporello“) mit den wichtigsten Fakten, weiterführenden Texten und Empfehlungen mit normativen und prozeduralen Hinweisen, über stationsinterne Lösungsversuche bis hin zum Ethikkonsil. Klinische Partner sind von Beginn an aktiv in den Entwicklungsprozess eingebunden und verbessern so die Praxistauglichkeit und Akzeptanz sowie die Ausrichtung des Instrumentariums an den tatsächlichen Bedürfnissen. Dieses partnerschaftliche, partizipative Vorgehen scheint eine wichtige Voraussetzung dafür zu sein, dass METAP in der Klinik Fuß fassen konnte. (shrink)

Recently, ethical guidelines for clinical practice have gained increased popularity, but in order to become useful they require more pioneer’s work. Clinical-ethical guidelines need to be based on a scientific foundation and their practicability must be improved. We present and put to discussion the initial steps of the METAP Project about the development and practical implementation of a clinical-ethical guideline dedicated to a fair resource-allocation at the bedside. -/- With its methodological orientation, the project represents a guideline which is based (...) on both research and consensus-building, undergoing systematic evaluation and modification. In addition to the guideline, the project comes with a manual (a tool kit) including a procedural instrument for making decisions supporting deliberative aspects. It focuses on issues of micro-allocation; furthermore, it provides empirical, ethical and legal basics for making fair treatment decisions that should help to prevent overtreatment, undertreatment or discrimination in patient care. We propose an Escalation Model with various instruments serving as problem solving strategies that correspond to the respective needs; these instruments include a pocket-summary (“Leporello”) with the most important facts; further reading material; normative and procedural recommendations; ward-specific strategies, and also the option of clinical ethics consultation. -/- Clinical partners have been actively involved in the developmental process from the beginning and contributed to the practical applicability, acceptance and a valid need-orientation of the whole tool kit. This partnership and the participatory approach seem to have helped METAP to gain a foothold in the clinic. (shrink)

_Asian-American Education: Historical Background and Current Realities_ fills a gap in the study of the social and historical experiences of Asians in U.S. schools. It is the first historical work to provide American readers with information about highly individual ethnic groups rather than viewing distinctly different groups as one vague, global entity such as "Asians." The people who populate each chapter are portrayed as active participants in their history rather than as passive victims of their culture. Each of the twelve (...) country-specific chapters begins with a description of the kind of education received in the home country, including how widely available it was, how equal or unequal the society was, and what were the circumstances under which the emigration of children from the country occurred. The latter part of each of these chapters deals with the education these children have received in the United States. Throughout the book, instead of dwelling on a relatively narrow range of children who perform spectacularly well, the author tries to discover the educational situation typical among average students. The order of chapters is roughly chronological in terms of when the first sizable numbers of immigrants came from a specific country. (shrink)

Recent approaches in the medical and social sciences have begun to lay stress on “plasticity” as a key feature of human physiological experiences. Plasticity helps to account for significant differences within and between populations, particularly in relation to variations in basic physiological processes, such as brain development, and, in the context of this article, daily sleep needs. This article proposes a novel basis for the redevelopment of institutions in accordance with growing awareness of human variation in physiological needs, and articulates (...) a theory of multibiologism. This approach seeks to expand the range of “normal” physiological experiences to respond to human plasticity, but also to move beyond critiques of medical practice that see medicine as simply responding to capitalist demands through the medicalization of “natural” processes. Instead, by focusing on how the institutions of U.S. everyday life—work, family, and school—structure the lives of individuals and produce certain forms of sleep as pathological, this article proposes that minor alterations in institutions could result in less pathologization for individuals and communities. Multibiologism provides a foundation for shared priorities in the social sciences, in bioethics, and in medical practice, and may lay the groundwork for emergent collaborations in institutional reform. This article argues that changes in the organization of social reproduction, defined to include the activities, attitudes, behaviors, emotions, responsibilities, and relationships involved in maintaining daily life, can explain historical differences in women's political self-organization. Examining the Progressive period, the 1930s, and the 1960s and 1970s, the authors suggest that the conditions of social reproduction provide the organizational resources for and legitimation of women's collective action.

The individual right of access to one’s own data is a crucial privacy protection long recognized in U.S. federal privacy laws. Mobile health devices and research software used in citizen science often fall outside the HIPAA Privacy Rule, leaving participants without HIPAA’s right of access to one’s own data. Absent state laws requiring access, the law of contract, as reflected in end-user agreements and terms of service, governs individuals’ ability to find out how much data is being stored and how (...) it might be shared with third parties. Efforts to address this problem by establishing norms of individual access to data from mobile health research unfortunately can run afoul of the FDA’s investigational device exemption requirements. Of the measures for resolving work—family conflict proposed by Janet Gornick and Marcia Meyers, government programs that provide or pay for nonparental child care would advance gender equality. However, paid parental leaves of six months for both parents, and the encouragement of part-time work, would retard it, and possibly reverse some of the advances toward gender equality that have been made in the home and the workplace. Female jobholders would increase their time at home to a much greater extent than (...) would male jobholders, increasing the share women do of child care, cleaning, cooking, and laundry. In the workplace, employers would become more reluctant to place women in nonroutine jobs, where substitution of one worker for another is difficult. Finally, recent studies of the effect on young children of nonparental care are reviewed. ID thus brings with it, as does supernatural theism by its nature, intractable epistemological difficulties. Despite these difficulties and despite ID's defeat in Kitzmiller v. Dover Area School District (2005), ID creationists' continuing efforts to promote the teaching of ID in public school science classrooms threaten both science education and the separation of church and state guaranteed by the U. S. Constitution. I examine (...) the ID movement's failure to provide either a methodology or a functional epistemology to support their supernaturalism, a deficiency that consequently leaves them without epistemic support for their creationist claims. My examination focuses primarily on ID supporter Francis Beckwith, whose published defenses of teaching ID, as well as his other relevant publications concerning education, law, and public policy, have been largely exempt from critical scrutiny. Beckwith's work exhibits the epistemological deficiencies of the supernaturally grounded views of his ID associates and of supernaturalists in general. I preface my examination of Beckwith's arguments with (1) philosopher of science Susan Haack's clarification of the established naturalistic methodology and epistemology of science and (2) discussions of the views of Beckwith's ID associates Phillip Johnson and William Dembski. Through a reinterpretation of publications, interviews with long-term activists, and an analysis of change in the social environment, this article explains why feminist ideology failed to create unity among feminist women in the United States during the period 1966-1975, the years when contemporary feminism emerged. In spite of the desire to create a community of women to challenge the existing sociocultural structure, schisms within the movement often created divisive and antagonistic feminist group relations. In contrast to earlier research that attributed (...) this lack of unity to competing ideologies, this article argues that, in many cases, feminist leaders used ideology and theory to promote radical self-identities that maintained existing social structural divisions. Thus, while feminism established a principle of unity for women as a group, disputes over ideological purity created divisions within the movement based on differences among women. (shrink)

At present, the structures, practice, and discourse of schooling are anchored to a “commercial spirit” that understands students, educators, and parents as economic operators trading competitively in human capital and to a discourse of failure that is disabling those who seek to understand and enact John Dewey's notion of education as democratic practice. Here Barbara Stengel illustrates both the commercial spirit in public schools and the discourse of school failure across two geopolitical settings: Shanghai, China, and urban U.S. schools. (...) She argues that framing the educational enterprise in terms of economic success and failure makes it difficult for educators to address Dewey's vision of democracy and education substantively. Političko je obrazovanje dio općeg obrazovanja; utoliko se doima smislenijim posvetiti se opsežnijem, kako bi se ono podrobnije moglo razvrstati na odgovarajući način. Stoga sljedeća promišljanja ne trebaju stajati direktno pod geslom »demokracija i obrazovanje«, već imaju za zadaću razjasniti pitanje »obrazovanja u uvjetima demokracije«. U tu će svrhu Bolonjski proces ponajprije biti prikazan kao izričaj dominantnog razumijevanja obrazovanja u Njemačkoj odnosno Europi. Nakon okretanja ka humboldtovskom pojmu obrazovanja kao izrazu ideala, nekoć karakterističnog za široka područja školskog i univerzitetskog obrazovanja (...) u Njemačkoj, daljnji povijesni korak unazad trebao bi dovesti do platonskog pojma obrazovanja – kao izraza onog humanizma koji je u 19. stoljeću Humboldt postavio kao mjerilo vlastite školske i univerzitetske reforme. Ausgehend von der phanomenologischen Beschreibung der konkreten Situation einer misslungenen Fremdheitserfahrung untersucht Barbara Schellhammer Motive der Selbstsorge in der Begegnung mit Fremdem. Die Archäologien gelten als junge Wissenschaften, da sie erst vom 19. Jahrhundert an zu universitären Fächern wurden. Die Ur- und Frühgeschichte beruft sich auf die Skandinavier Thomsen und Montelius, die Klassische Archäologie auf Winckelmann. Ältere, als antiquarisch und vorwissenschaftlich bezeichnete Arbeiten schließt man aus der Fachtradition aus. Eine vergleichende europäische Wissenschaftsgeschichte archäologischen Forschens vor dem 19. Jahrhundert ist deshalb ein Desiderat. Die Autorin füllt diese Lücke, indem sie in ihrem zweibändigen Werk Arbeiten mit archäologischem Inhalt aus verschiedenen europäischen Ländern auf (...) ihre grundlegenden Konzepte, Fragestellungen und Methoden hin untersucht. In Studien zu einzelnen Arbeitsschritten geht sie u. a. der Frage nach, inwieweit und unter welchen sozialen und politischen Bedingungen vor der akademischen Fachbildung methodische und konzeptuelle Arbeitsnormen entstanden und sich durchsetzen konnten. Sie kann zeigen, dass archäologische Quellen seit der Antike als wissenschaftliche Beweise dienten, Untersuchungsmethoden zielgerichtet entwickelt wurden und heutige fachliche und nationale Ausprägungen tiefe historische Wurzeln haben. Der zweite Band ist der Zeit von 1630 bis 1852 gewidmet. Sasse erfasst damit die Anfänge der Institutionalisierung, die von der Entwicklung der Grabungsmethodik sowie der Erfindung des heute noch grundlegenden Dreiperiodensystems geprägt sind. Skandinavien, das deutsche Sprachgebiet, England und Frankreich stehen im Fokus. Deutlich wird, dass einige Ergebnisse seit 1660 wesentlich zur europäischen Säkularisierung beitrugen. Erst die Methoden zur Beobachtung und Bearbeitung von Fundkomplexen und die Definition kultureller Kontexte seit 1750 jedoch schufen die Voraussetzung zur Formulierung tragfähiger Fachparadigmen. Es ist ein Charakteristikum der hellenistisch-kaiserzeitlichen Lebensphilosophie, dass sie der ethischen Ausbildung des Menschen fuer die Lebenspraxis zentrale Bedeutung zuweist. Philosophie wird praxisbezogen und genieat den Stellenwert einer Lebenskunst (ars vitae). Dies gilt in besonderem Maae auch fuer Epiktet (ca. 50-135 n.Chr.), der in den Lehrgesprachen (Diatriben) seinen Schuelern Hilfen zur Bewaltigung des taglichen Lebens an die Hand gibt. Die vorliegende Monografie untersucht anhand einer eingehenden Analyse der vielschichtigen Dialogstruktur von Epiktets Lehrgesprachen die von Epiktet angewandten Mittel der Willenserziehung und (...) kommt u.a. zu dem ueberraschenden Ergebnis, dass Epiktet bereits Methoden wahlt, die auch in der modernen Psychologie Verwendung finden. U.S. regulations do not afford consistent protections to human research subjects. One complaint is that they focus on federally sponsored research, with private research covered only if it falls under the jurisdiction of the Food and Drug Administration. This paper examines a deeper problem: Even when the regulations do apply, they still do not afford consistent standards of protection. The U.S. Common Rule and related FDA regulations lack a workable regulatory control mechanism.
